UK Visa - The Easy Way to Apply

If you plan to visit the United Kingdom, you will most likely need a visa. Your visa is a document that is placed in your passport, which allows you to enter the United Kingdom for a certain amount of time.

It is not difficult to obtain a British visa, but you do have to have all of your documents completed correctly. First, be sure your passport is not expired or damaged. Then, be sure of your exact travel plans, including dates and addresses.

The easiest way to apply for your visa is by filling out an online form. You will need to create a username, password, and provide your email address to get started. Then you can fill out the application over time and save your work, or just do it all at once.

There are different types of British visa forms, and they vary based on the purpose of your visit. If you plan to study in the United Kingdom, there is a special form. Likewise, if you are going there for work, there is another. If you are going on a family trip, every member of the family must make a separate application.

There are two ways to fill out the appropriate forms: by hand or online. Either way, you will have to appear at a visa application center in your country. There are 129 authorized centers in the United States.

When you arrive for your appointment, you will have to furnish your documentation, including your passport and additional photos. Currently, all applicants who are US citizens must use the online application. They also have to submit to a biometric fingerscan.

Once you are approved for your visa, you can stay in the United Kingdom for the specified time length. When your visa expires, you can apply for an extension or simply leave the country.

The UK visa application form is easy to complete as long as you stay organized and follow the instructions. If any problems or questions arise, use the Internet, which will be your best resource throughout the process.

10 Easy Tips to Help You With a UK Visa Application

Preparing your own immigration application to apply for a visa to the UK or extending your current leave may seem an overwhelming experience, however we wish to help you with 10 easy tips which you can apply to navigate the process.

1. Read and read again the immigration requirements specific to your own category. You have selected your immigration category and even established through the UK Border Agency (UKBA) points based calculator that you are able to claim enough points to qualify, well done! However, make sure that you identify the specific requirements by checking UKBA website.

2. Do not cut corners. If in doubt, always assume that the UKBA or the British Embassy will not exercise their discretion in your favour. Most of the requirements are mandatory and you will need to show that you do meet these by providing the required evidence. Never assume a caseworker will apply common sense when considering their application, they have a limited time and resources to establish your exact situation thus make sure that you explain in detail your circumstances and provide evidence to support your claims. Be particularly careful when it comes to the maintenance requirement!

3. Prepare the application form with accuracy. Reduce the chances of a refusal by carefully completing the application form, make sure that you have filled-in all relevant sections, answer truthfully all the questions (especially in case of a prior refusal), sign and date the application form.

4. Evidence. All documents unless specified need to be original. Your application might be refused on the basis that you have only provided copies or not all the required evidence. Make copies of everything you send to the UKBA/ British High Commission.

5. Cover letter. Always prepare a cover letter to accompany the application bundle explaining your immigration history, how you meet the different points and listing all the documents.

6. Payment. This might be an obvious tip, however make sure that you have paid the correct fee and if you have decided to pay by credit card, alert your bank of the impending transaction or in the alternative pay by postal orders or banker draft. An invalid application can lead to become an over-stayer.

7. Post using special recorded delivery. This might again be self explanatory, but it's SAFER to send your bundle by recorded delivery than dealing with the headache and repercussion of a lost passport or important documents.

8. Always check your visa expiry date! If you were to make an application after the expiry of your leave, you might lose your right of appeal.

9. Do not wait until the last minute to submit the application! Try to allow sufficient time for the submission and the processing of the application before you make any travel arrangements.

10. Legal advice does not have to be expensive! If your situation is not straightforward, you had previous refusals/adverse immigration history, or if you are not fully confident you have all relevant documentation speak to an immigration solicitor or an OISC registered consultants. They often offer documents checking service which is cheaper than the full representation and could buy you a peace of mind as well as save you the government fee if your application is unsuccessful.

Work in the UK With the Tier 1 UK Visa Program

Are you the kind of person who enjoys exploring the world? If you are of a certain age and a skilled professional, you should consider applying for the Tier 1 UK Visa program. This program is ideal for someone who wants to live and work in the UK, as you can receive up to three years of legal residency in the country.

However, not just anyone can apply for the Tier 1 UK Visa. There are different qualifications needed to become eligible, as each of the characteristics equal so many points. The more points you score, the easier it is to be accepted. The minimum amount needed to become accepted is 100 points, and these points come from being of a certain age, having specific qualifications, specific earnings, can speak English, have monetary funds, and already have experience in the United Kingdom.

If you score high in each of these categories, it is much easier to become accepted into the program. There is no need for a sponsor or having a job in place beforehand. There won't be anyone restricting your employment while you are in the country, allowing you to gain valuable working experience in whatever area of study. Are Embassies a Safe Place or Wise Choices for the Twenty-First Century?

We've been told, and you can probably read this in any given issue of Foreign Affairs Magazine, or on the news alerts from the Council on Foreign Relations that there is a culture clash between the Middle East and the Western World. Indeed, that would be hard to deny wouldn't it, at least judging by global world events which hit our newspapers and online news each and every day. We are told by academics, at least in the United States, that "we must win the hearts and minds" of Islam.

One of the best ways is through sharing our cultural differences, history, and developing dialogue. Regardless of what's going on in the world, that is a good idea. After all, we live on the same planet, and so far no one has escaped, that we know about. We are all in this together, and therefore we share more than we might realize, and yes, including our DNA. However, I ask; how can we share our culture, our ideas, or even our humanity if our embassies are constantly attacked?

And, why exactly are our embassies attacked in the first place? Is it because these are the only symbols that those who may be ignorant of our culture recognize? In other words, our embassies are attacked because they are a symbol of the Western World, a symbol of our ideals, and culture. Obviously, we must not be reaching our goals of; winning their hearts and minds. It seems that at least a small group aren't interested in our culture, and yet, demand that we recognize there's and change our society to serve their political will.

There was a rather troubling article recently in Reuters on December 2, 2011 titled; "Over 20 arrested at U.S. London embassy protest," which stated;

"Police arrested 20 outside the U.S. embassy in London on suspicion of being members of a banned group, 2 for obstruction and violent disorder," and it appears that the protesters "were members of Muslims Against Crusades (MAC), a fringe Islamist group. MAC, which was banned after the 2010 protest for burning poppies on Remembrance Day and chanted "British soldiers, burn in hell," and they also held a demonstration outside the U.S. embassy on the 10th anniversary of the 9/11 attacks on America."

The week before, in Iran the UK embassy was attacked, perhaps due to stiff economic sanctions, but why were the sanctions put into place to begin with? Because the government of Iran is pursuing nuclear weapons, and that's a big problem because the government of Iran also supports international terrorist groups; Hezbolla and Hamas (officially designated terrorist groups by the US State Department).

If the embassies in these countries are constantly being attacked, and exploited in their local media, and if they are seen as infiltration of the Western World, which they do not want apparently, or certain members of their society don't appreciate, then there is no sense in exchanging culture or dialogue, and therefore maybe the embassies shouldn't be there in the first place, because they are seen as pouring salt into the wound. In other words, maybe cultural sharing between these two worlds isn't working. Therefore, shouldn't we be trying something else in the 21st century?

That's all I'm saying, and that's the question I pose to you here today. Please consider all this and think on it.

So, an individual can apply for a UK settlement by using the SET(M) form if their partners are already settled and have a proper standing in the UK.

Some of the other guidelines to apply for form SET(M) are given below:

If the candidate already has temporary permission to live in the UK at present for the reason that their partner is already settled in the country. The candidate can be a husband, wife, civil partner, same gender partner or unmarried partner.
If the candidate has lived in the UK for 2 or more years.
If the candidate is planning to settle in the country in the future.
A Few Advantages of Form SET(M):

The candidate can use the same form for joint applications.
For instance, candidates can include their children in the same form they are using to apply. The only clause is, children should be less than 18 years of age.
Submit these forms at an SCS (Systems Consultants Services) UK or send them by post to the Home Office. The address should be scrupulously written on the cover of the form.
SCS: Independent UK-based Consultancy which assists clients in meeting their demands, providing a broad range of services.

Form SET(O)

Form SET(O)is a different form which is used for a different function. The candidates need to apply for ILR with this form if they are in the following categories:

in Tier 1 or Tier 2 in the points based system
having work permit
an innovator
an investor
an overseas government employee
a self employed lawyer
ancestry is from the United Kingdom
placed in the category of HSMP (Highly Skilled Migrant Programme)
can use this form if you are minister or member of a religious organisation
a writer, composer or an artist or a private servant in a diplomatic household
Domestics who work in a private household can also use this form
associated with a private newspaper or news agency
If an individual belongs or comes under any of the above categories then he or she can avail this SET(O)form. A few important points to remember is that persons applying for this form need to have a good control over the English language. No certain time limit is there to accept or decline the application. The procedure depends on processing of the application based on the person.

Mostly this procedure varies from person to person for the application process. Both the forms (Form SET(M) & Form SET(O)), should be filled using a black pen in block letters.

Student Visa - Advice From a UK Immigration Lawyer

Foreign students who have no indefinite leave to remain in the UK or students from countries other than EEA need a student visa if they wish to study in the United Kingdom. If this is your case, then

1. Get an admission letter from a UK institution.

o Start by choosing a study plan with at least 15 hours per week. The same institution must offer these. Evening classes do not count.

o Make sure you can demonstrate that you will be able to follow the course, generally speaking, that you have the necessary financial support to pay the fees required by the institution.

o Gather all the documentation you can find to show that you will not need to depend on public funds for your maintenance, including any dependents. Bank statements will help. Maybe a letter from your sponsor, if you have one, will do too; and one from friends or relatives already in the UK willing to help and support you will add some credibility.

o Also, whenever possible, get a receipt from your institution. Showing that you paid the fees in advance also pays when it comes to visa issues, especially if you have an unconditional admittance offer from an approved UK institution.

2. Find an immigration lawyer in the UK. Yes, you can go through the entire process on your own; however, visa matters and UK immigration law are complex and your chances improve exponentially if you hire a competent lawyer.

3. Apply for a visa online or at the nearest British embassy in your country.

o Download the form from the UK Border Agency: http://www.ukvisas.gov.uk

To submit a visa application online successfully, gather the following BEFORE logging in to the UK Border Agency website:

o passport number

o photograph

o visa fee

4. Get an interview date.

If you submit a visa application online, at the end of the process you will get a date for an interview at the nearest embassy. As you wait for this important date, all the submitted documentation will pass a screening process; meanwhile, you can learn how to introduce yourself. To have a good chance, you need to impress your interviewer favorably.

The immigration officer at the embassy will ask questions to find out:

a) whether you intend to work or do business. Foreigners cannot work in the UK without permit; as a student, you will not get such authorization.

b) whether you intend to stay in the UK after finishing your course. The government expects foreign students to return to their countries of origin (unless they meet certain criteria).

How do you demonstrate your willingness to return to your country? Usually, you need to show some form of ties to your homeland; for instance: property you own (land, home or business). Other evidence could be a letter from an employer stating that the company or organization will preserve the post for you until you return from a study leave. This could work if you have a high quality job (one you would hardly quit).

ESOL Citizenship Course - Are You Aware of the New Changes of Studying at an Accredited College?

There have been significant changes made by the Home office to the provision of the ESOL course with a citizenship context as from 7 April 2010.

Before I indulge into the main requirements and who this course applies to, you may ask what is ESOL? ESOL is short for English for Speakers of Other Languages. In 2007 the UK government introduced a new requirement for anyone applying for indefinite leave to remain in the UK or applying for naturalization as a British citizen, that knowledge of life in the UK and sufficient knowledge of the english language was a necessary requirement.

Currently there are two ways that this can be done:

Firstly if ones command of English is of a sufficient level ie above entry level 3 you may study for the life in the UK test. You may see whether your standard of English is sufficient to understand the tutorials on the life in the UK website lifeintheuktest.gov.uk otherwise, secondly you will need to take and pass a course in ESOL which contains Citizenship materials if your English is below entry level 3.

In the latter the Home office has introduced new changes as from 7 April 2010. In order to satisfy the new Home office requirements you will need to obtain an ESOL qualification studied within a citizenship context at an accredited college through an approved awarding body. You can pick up more guidelines on this on the UK Border Agency website: http://www.ukba.homeoffice.gov.uk

This new measure by the Home office was introduced following misuse by some bogus centres charging students in some cases extortionate amounts in fees and providing them with a printed certificate from no approved awarding body. Unfortunately many students have suffered as a result of these bogus institutions set up right across the UK.

It is very important that anyone wishing to study on an ESOL citizenship course that they do so at the right institution which has been approved by the appropriate awarding body and has accredited college status.

I can recommend several institutions which are Home office approved and offer high quality education and provide students with additional support and guidance in their studies.

American Visa Application Refusal And Section 221(G) of the Immigration and Nationality Act

This piece examines visa denials issued pursuant to section 221(g) of the American Immigration and Nationality Act.

U.S. Citizens who are in an ongoing relationship with a foreign born fiance(e) or spouse will be required to submit a petition for visa benefits in order to hope to ultimately be granted United States Immigration benefits. Bearing this in mind, the mere act of submitting a visa petition to the U.S. Citizenship and Immigration Service (USCIS) is simply one aspect of the American visa process as most foreign born family members must undergo consular processing at an American Embassy, Consulate, or Mission outside of the USA.

After the US Citizenship and Immigration Service finishes an adjudication of an American Immigration petition, if the petition is approved, the file will be sent to the US State Department's National Visa Center (NVC). In a way, the National Visa Center is something akin to a clearinghouse for United States visa applications and the documentation which is attached thereto. In K-1 visa cases (the technical term for a United States fiancee visa), NVC processing is comparatively fast. At one time, this was also the case in U.S. Marriage visa matters where the bi-national couple was seeking a K-3 spouse visa, but at one point during the year 2010 the National Visa Center began administratively closing many K-3 visa applications thereby compelling many bi-national married couples to seek Immigrant travel documents for foreign husbands and/ or wives commonly referred to as either the CR-1 visa or the IR-1 visa depending upon the elapsed time period since the date of the underlying marriage. In any case, after NVC processing is complete the US visa application will be directed to a United States Mission abroad for the visa interview.

The visa interview process is different at each Post abroad. Although, some characteristics of consular processing remain the same as some facets of the process are derived solely from relevant United States Federal law. The 221(g) is a visa denial, although it is sometimes referred to as a refusal. In any case, those issued a 221(g) are generally not granted a visa until further documentation is presented to the Consulate or some other deficiency is remedied. In certain instances, a 221(g) denial might be issued concurrently with a finding that a foreign national is legally inadmissible to the United States. Under circumstances such as this, the only method of overcoming the finding of inadmissibility would be through utilization of an I-601 waiver. However, not all grounds of inadmissibility can be waived. Therefore, those who believe that they may be inadmissible are well advised to contact an American attorney for further information in an effort to efficiently and effectively process an application for visa benefits. Taking into consideration the caseload of the various Consular Posts around the globe, a 221(G) refusal may be remedied quite fast or it could take a great deal of time before a finalized decision is made in a pending case.

With borders across nations becoming porous, it is incumbent on each nation to verify the credentials of every foreign visitor who visits the country. The immigration authorities of each country validate verification of a foreign visitor's credentials by a stamped certificate on the applicant's passport, which is termed as visa.

The visa also grants permission to the applicant to enter the county for a temporary period within a specified period also marked on the visa and termed tenure or validity of visa.

Foreign nationals wishing to visit India should possess their parent country's valid passport and a valid Indian Visa. The application for this can be made at any of the High Commission abroad. The visa fees and terms of entry are subject to the High Commission's discretion and immigration laws in force at the time of issuance.

Nationals of countries like Burundi, Cape Verde, Haiti, Mauritius, Jamaica, Maldives and Mongolia can avail the free visa facility. There is no visa requirement for nationals of Bhutan and Nepal.

Procedure for Visa Application

Visa application forms can be collected from the Indian Embassy or High Commission where the foreign national resides. Visa forms for Pakistani and Bangladeshi nationals are different than those for nationals of other countries. The visa form for Persons of Indian Origin differs from those for foreign nationals. Points of Caution

• Though a valid visa may be issued for a period exceeding six months, the duration of stay in India for a person on a tourist or business visa cannot exceed six months.

• The validity of the visa is linked with the validity of the passport i.e. if the visa validity exceeds the validity of the passport, it does not hold good for the period beyond passport validity.

• Validity of all visas starts their date of issue.

• Tourist visa up to five years may be granted if the foreign national is connected with the tourism trade.

• If the visa is valid for more than 180 days, the foreign national needs to register himself with the Department of Immigration within 14 days of arrival.
